Busia Governor Paul Nyongesa Otuoma is facing serious legal pressure. A court has ordered him to appear in person. He must explain why he should not be jailed for contempt. The case involves disputed public land in Busia County.

In a ruling delivered on December 17, Judge Boaz Olao said the governor ignored court orders. The judge ruled that the disobedience was deliberate. The court also cited Peter Khasamule Odima. He is the County Executive Committee member for Lands. Both were named respondents in the contempt proceedings.
The court issued strict instructions. Governor Otuoma and Odima have 14 days to act. They must file written undertakings. These must confirm full compliance with orders issued on June 27 and July 10, 2024. They were also ordered to appear in court on March 2, 2026. On that date, they must show cause why they should not be sent to civil jail.
The dispute began with a petition filed on June 19, 2024. Busia Senator Okiya Omtatah Okoiti filed the case. He accused the county government of illegally converting public land. The land hosts key institutions. These include the Busia Vocational Training Centre, Soko Posta Market, and the Agricultural Training College.
After the petition, the court issued conservatory orders. All transactions and developments were halted. The orders were later extended. The court clearly directed that all activities stop. This was to remain so until the case is determined.
However, the court found that activities continued. Odima claimed the developments began earlier. He denied any wrongdoing by the governor. Still, the court noted a key issue. Governor Otuoma did not file any personal response.
Judge Olao also cited a letter from Odima. The letter acknowledged re-allocation of the land. The judge ruled that Odima could not deny that position later.
The court issued a strong warning. Court orders are not optional. Compliance is mandatory. This applies to everyone, regardless of rank or office.
