The High Court has suspended a KSh 2.1 billion roads maintenance deal between Nakuru County and the National Youth Service (NYS). The move comes after a petition claiming the agreement ignored procurement rules and lacked public input.

The petition was filed by Paul Muchiri and Kepha Omuyoma. They argued that the county and NYS signed the deal on November 7, 2025, without proper procedures. They asked the court to stop the deal from being operationalized. They also sought to prevent any payments until the case is resolved.
Justice Julius Nangea certified the petition as urgent. He issued conservatory orders halting the deal. The case is scheduled for mention on January 19, 2026. The judge directed the county and NYS to file responses within seven days. All parties must exchange written submissions within 21 days.
The deal, under the Imarisha Barabara programme, aimed to maintain all feeder roads in Nakuru for one year. After the ruling, MCAs and local leaders welcomed the decision. They accused Governor Susan Kihika of flouting the law and bypassing the county assembly.
Naivasha East MCA Stanley Karanja criticized the executive for allegedly intimidating ward leaders. He asked why the county needed NYS machinery when previous governors had left idle equipment. Karanja said the county ignored the Public Procurement and Asset Disposal Act. The law prioritizes job opportunities for youths, women, and people with disabilities. He urged fellow MCAs to perform oversight duties and resist intimidation.
Another leader, Edward Maina, said the county ignored mandatory public participation. Residents were denied a chance to approve the process. He warned that bypassing these rules undermines transparency and accountability.
The High Court’s suspension emphasizes the need to follow procurement laws. It also highlights tension between Nakuru’s executive and legislative arms. Oversight and transparency remain key concerns for local leaders and residents.
