High Court Suspends Controversial Kenya–US Health Deal Over Data Sharing Concerns

The High Court has halted the implementation of the Kenya-US health agreement. The order stops the government from sharing any health data with the United States. The case is set for mention in February 2026.

The five-year deal aimed to strengthen Kenya’s healthcare system. The US pledged about KSh200 billion. Kenya would contribute roughly KSh130 billion. The agreement targeted primary healthcare, treatment of major diseases, expansion of the health workforce, and improvement of digital health systems.

It also shifted health support from NGOs to government bodies. KEMSA and the Social Health Authority were set to take the lead. Proponents said the move would improve efficiency, accountability, and sustainability in service delivery.

Controversy erupted over a clause allowing the sharing of anonymized health data with the US. Critics feared it could compromise patient confidentiality. They argued the public was not consulted before the deal was signed. Concerns grew over the protection of sensitive medical information.

The court challenge prompted the suspension. It highlighted the need to safeguard citizens’ constitutional rights. Until the case is heard, the government cannot release any data to foreign entities.

Legal experts say the ruling shows increased scrutiny over international partnerships that involve citizen data. While the deal promises funding and capacity building, questions about transparency and ethical use remain central.

Government officials defended the agreement. They said it is legally sound and protects Kenyan interests. They argued the funding and reforms are crucial for expanding access, modernizing services and strengthening the national healthcare system.

The High Court suspension underscores tension between foreign partnerships and domestic accountability. Stakeholders are watching closely. The case will determine how Kenya balances international cooperation, data protection and urgent healthcare needs.
