Maraga Slams Ruto Over Controversial Bills Amid National Mourning

Former Chief Justice David Maraga has launched a fierce critique of President William Ruto’s administration, accusing it of undermining Kenya’s democracy and flouting the 2010 Constitution. His comments come amid national mourning following the death of former Prime Minister Raila Odinga, highlighting what Maraga calls “a troubling disregard for the nation’s values and the people’s will.”

Speaking at Nairobi’s Panafric Hotel on Tuesday, Maraga described the signing of eight controversial Bills as “insensitive” and ill-timed. “These laws were enacted while the country was grieving, mocking the principles Raila Odinga stood for,” he said.

He singled out amendments to the Computer Misuse and Cybercrimes Act, warning they could stifle free speech and political dissent. The changes empower a government committee to block websites and social media platforms, including Facebook, YouTube, and TikTok, without judicial oversight. “This creates a dangerous precedent where the investigator becomes the judge, violating media freedom and citizens’ rights,” Maraga said.

The former Chief Justice also criticized Parliament for sidelining public input and ignoring submissions from relevant government ministries. He called the Bills “unconstitutional, null, and void” and revealed that legal challenges are already underway.

Maraga further condemned the Privatization Act, arguing it allows the government to dispose of public assets without transparency or parliamentary approval. “This law could let national assets be sold to proxies of those in power, leaving Kenyans in the dark,” he warned.

He also raised alarms about the country’s spiraling debt, noting the government borrows over five billion shillings weekly. “Who does this administration serve? Young Kenyans have already sacrificed to protect justice and fairness,” he said.

Maraga concluded by urging citizens to defend their freedoms. “We cannot allow our rights to be eroded quietly. Action is underway to challenge these laws and safeguard our democracy,” he emphasized.
