Nairobi Lawyer Seeks Court Order to Ban Loud Music in Matatus Over Rights Violations Nationwide

A Nairobi-based lawyer has moved to the High Court. He wants matatus barred from playing loud music. He says the practice violates commuters’ constitutional rights. The case has renewed debate on noise pollution in public transport.

The petitioner is advocate Samwel Barongo Nyamari. He has sued the Matatu Owners Association. He has also sued NTSA, NEMA, and the Attorney General. He accuses them of failing to protect the public. He calls the loud music cruel and disturbing noise. He says it is disguised as entertainment.

Nyamari says he has lived and worked in Nairobi for six years. During that time, he has used matatus often. He says he has endured loud and repeated music on many trips. He argues that this amounts to psychological torture. He adds that it is a form of noise pollution.

The lawyer says the problem affects everyone. However, he notes it harms vulnerable groups most. These include children, the elderly, the sick, and people living with autism. He says constant exposure causes stress and health risks.

Nyamari links the practice to constitutional violations. He cites the right to a clean and healthy environment. He also cites freedom and security of the person. He adds that consumer rights are ignored. He says commuters are denied dignity and choice.

The petition says many Nairobi matatus have powerful sound systems. The music plays loudly all day. Passengers are not warned before boarding. As a result, they cannot make informed choices.

Nyamari says loud, drum-heavy music can damage hearing. He says it affects mental well-being. He calls it an invisible form of violence. He argues it lowers transport standards.

He also blames NTSA and NEMA. He says they have failed to enforce noise laws. He accuses the State of neglecting its duty. He now wants the court to ban loud music in matatus and order strict enforcement.
