Senator Karen Nyamu Proposes AI Bill to Regulate Artificial Intelligence in Kenya

Senator Karen Nyamu has introduced the Artificial Intelligence Bill, 2026, to oversee AI use in Kenya. The bill aims to create the Office of the Artificial Intelligence Commissioner. This office will monitor AI systems, enforce ethical standards, and manage potential risks.

The President will nominate the AI Commissioner, who must get parliamentary approval. The Commissioner will have authority to inspect AI systems, access records, summon individuals, and issue compliance directives. “The Commissioner will classify AI systems by risk, issue enforcement orders, and develop ethical guidelines,” the bill says. Companies using AI must also keep detailed records of data, model outputs, and performance for five years.

The bill focuses on protecting individuals from harmful AI tools, including deepfakes. AI developers must get consent to use someone’s image, voice, or likeness and clearly label AI-generated content. Those who break the law may face fines up to KSh 5 million, imprisonment up to two years, or both.

To support regulation, the bill proposes an Advisory Committee on AI. Members will include representatives from the ICT Ministry, Data Protection Office, National Commission for Science, county governments, private companies, and civil society. The committee will guide ethical standards, risk management, and responsible AI innovation.

Senator Nyamu says the law balances innovation and safety. “This bill protects citizens while allowing AI to grow responsibly,” she explained. High-risk AI providers will submit yearly compliance reports, with non-confidential information available to the public. This ensures transparency and accountability.

The bill is now under parliamentary review. Lawmakers, tech experts, and civil society are expected to debate its details. Many believe that if passed, Kenya could become a leader in AI governance in Africa. The legislation aims to encourage innovation while ensuring AI systems are safe, ethical and accountable to the public.
