A voter has gone to court to stop the Independent Electoral and Boundaries Commission (IEBC) from preparing for the 2027 General Election. He claims the current electoral system is unconstitutional and a waste of public money.

In his urgent petition, Bernard Mwanzia wants the court to suspend all IEBC activities linked to the next polls. He says no funds should be spent until the court rules on the legality of the framework.
Mwanzia argues that the ongoing preparations could waste billions if the process is later declared illegal. “The court must protect the sovereignty of the people, not fund an unlawful process,” he says.
He adds that halting IEBC’s work will protect taxpayers and uphold constitutional values. “Stop wasting public funds on a flawed system,” Mwanzia urges in his affidavit.
The petitioner also seeks an order barring the IEBC and its agents from using public resources until the case is heard and determined. He believes the balance of convenience favors suspension until clarity is achieved.
The case comes as the IEBC faces pressure to reform its structure and rebuild public trust. Ongoing debates over the IEBC (Amendment) Bill, 2024 have added to uncertainty about the next election.
Analysts say the suit could slow down the 2027 election roadmap if the court agrees to freeze preparations. However, others believe the move could also push the Commission to fix legal gaps before the next vote.
Mwanzia insists his petition is not political but constitutional. He says Kenya needs a credible and lawful system before another election is held. The High Court will now decide whether to pause IEBC’s 2027 plans or let the Commission proceed under close watch.
