“We Don’t Need a New Constitution” – Former CJ Maraga Rebukes Mudavadi, Launches Ukatiba Movement to Defend the Law

Former Chief Justice and 2027 presidential aspirant David Maraga has strongly criticized Prime Cabinet Secretary Musalia Mudavadi. He opposed calls to amend the 2010 Constitution. Maraga said the proposed changes are politically motivated. They aim to consolidate power, not serve the people.

In a statement on Monday, December 29, Maraga argued that Kenya faces leadership failures, not a constitutional crisis. He dismissed Mudavadi’s claim that the country is in a “constitutional moment.” “Kenya does not have a constitutional crisis. We have a crisis of implementation and a deficit of integrity,” he said.

He questioned the moral and legal authority of leaders pushing for changes while holding offices not recognized by the Constitution. “It is ironic and legally problematic when individuals in unconstitutional offices lecture Kenyans on constitutional fixes. They have no authority to dictate amendments,” he added.

Maraga accused the government of undermining the Constitution under the guise of reform. He said Kenyans do not demand new clauses. They want full implementation of the existing law, including the two-thirds gender rule, proper Judiciary funding and protection of the Bill of Rights. He criticized proposals for amendments amid economic hardships. Asking struggling citizens to fund a bigger government is insensitive, he said.

Maraga announced the launch of the Ukatiba Movement. It is a citizens’ initiative to defend the Constitution and prevent a bloated, illegal bureaucracy. “Our mission is to protect Kenyans from the costs of an oversized administration. Power must remain with the people. We do not need a new Constitution. We need leaders who respect the one we have,” he said.

Maraga’s statements highlight a push to protect Kenya’s supreme law. The focus, he said, should be on implementation, not expansion for political gain.
