Three men have been sentenced to death for the January 2008 killing former Embakasi MP Melitus Mugabe Were.
A fourth accused was however freed by High Court Judge Mr Justice Luka Kimaru.
The judge ruled that the prosecution had proved that James Omondi, Wycliffe Simiyu and Paul Otieno killed Mr Were on January 29, 2008.
“Having analysed the evidence and the accused person’s decision not to ask for mercy, I sentence them to death as prescribed in law,” the Judge ruled.
Ms Mary Wamaitha, who was charged alongside the three men, escaped the death sentence after Justice Kimaru set her free saying there is nothing to link her to the former MP’s murder.
Mr Were was killed by gunmen in Woodley Estate, Nairobi shortly after the 2007 general elections.
